About this deal

The question of whether or not a claimant can be excluded from the protection of the Refugee Convention is part of the refugee status determination. If, after considering the facts of the case in accordance with this guidance, there are serious reasons for considering that the claimant has committed a crime or act contrary to Article 1F, asylum must be refused. Reasons for exclusion must relate to the most relevant clause 1F(a), (b), or (c), but it is possible for more than one clause to apply, for example, those who engage in certain acts of terrorism should be considered for exclusion under Article 1F(b) as well as 1F(c). The UKCA are the competent authority for extradition requests made under Part 2 of the 2003 Act (such as, non-EU countries with whom the UK has extradition arrangements).
